Welcome to FondPix. These Terms of Service ("Terms") govern your access to and use of fondpix.com, the FondPix AI wedding photo generator, and related services (collectively, the "Service"). By using FondPix, you agree to these Terms. If you do not agree, do not use the Service.

1. About FondPix

FondPix is an AI wedding photo studio that lets users upload personal reference images, choose wedding styles, scenes, poses, outfits, purposes, prompts, and output settings, then create AI-generated bridal portraits, couple wedding photos, destination wedding looks, invitation images, and album-ready visuals.

FondPix is a technology service. It is not a professional photography studio, wedding planner, printing service, legal service, or identity verification service.

2. Eligibility

You must be at least 13 years old to use FondPix. If you are under 18, you may use FondPix only with permission from a parent or legal guardian. By using the Service, you confirm that you meet these requirements and that your use is lawful in your location.

3. Accounts

You may need an account to upload images, generate photos, buy credits, download results, or view task history. You agree to provide accurate information, keep your credentials secure, and promptly notify us at support@fondpix.com if you suspect unauthorized access.

You may not create duplicate accounts to abuse free credits, avoid limits, evade enforcement, or interfere with the Service.

4. Credits, Pricing, and Payments

FondPix may offer free trial credits, one-time credit packs, paid plans, subscriptions, or promotional credits. Pricing, included credits, output limits, validity periods, and feature access are shown on the pricing or checkout page at the time of purchase.

Credit usage may vary by generation type, quality, and resolution. FondPix currently supports image-to-image wedding generation with credit costs such as 2K and 4K outputs, and costs may change as models, providers, or product features change.

Payments are processed through Creem and PayPal, depending on availability at checkout. For transactions processed by Creem, Creem acts as merchant of record and may issue the customer receipt or invoice and handle applicable indirect taxes through its checkout flow. You agree to provide accurate billing information and authorize applicable charges through the selected payment provider.

Unless required by law or expressly stated otherwise, completed purchases are non-refundable. If a generation fails and credits are not automatically returned, contact support@fondpix.com for review. Refund and dispute requests for Creem transactions must be handled through FondPix and Creem's supported processes, not through a separate off-platform refund method.

We aim to respond to billing, refund, and support requests within 3 business days.

If subscriptions are offered, cancellation takes effect at the end of the current billing period unless the checkout terms state otherwise.

5. Your Photos and Content

You keep ownership of photos, prompts, notes, and other content you upload or submit to FondPix ("User Content"). By submitting User Content, you grant FondPix a limited, worldwide, non-exclusive license to host, transmit, process, reproduce, display, and modify that content solely as needed to operate the Service, create requested AI outputs, provide downloads/history, prevent abuse, and provide support.

You represent that:

You own or have permission to use all photos and content you submit.
You have consent from each identifiable person in uploaded images.
Your content does not violate privacy, publicity, intellectual property, contractual, or other rights.
Your content does not contain illegal, exploitative, sexualized minor, non-consensual intimate, NSFW, sexually explicit, sexually suggestive, defamatory, harassing, or harmful material.

We may remove content, block uploads, cancel tasks, or suspend accounts that violate these Terms or create legal, safety, or operational risk.

6. AI Outputs

AI-generated images may vary based on input quality, prompt wording, selected template, model behavior, provider availability, and other factors. FondPix does not guarantee exact likeness, perfect anatomy, specific artistic results, absence of artifacts, or suitability for any particular use.

Subject to your compliance with these Terms, you may download, share, print, and use AI outputs generated from your own authorized photos for personal purposes. Commercial use may require a separate commercial license or plan if FondPix offers one.

You are responsible for reviewing outputs before use. Do not present AI-generated images as real documentary photography where that would mislead others or violate law, platform rules, or third-party rights.

7. Prohibited Uses

Our Acceptable Use Policy is part of these Terms. You may not use FondPix to:

Impersonate, deceive, defraud, harass, threaten, or harm another person.
Create face swaps, deepfakes, impersonation content, or misleading images of real people.
Generate NSFW, nude, pornographic, sexually explicit, sexually suggestive, exploitative, or abusive content, especially involving minors.
Upload images of people when you lack the required rights or consent.
Infringe copyrights, trademarks, publicity rights, privacy rights, or other rights.
Bypass credits, rate limits, access controls, watermarking, or security measures.
Scrape, overload, reverse engineer, or interfere with the Service or its providers.
Resell FondPix outputs as professional photography services without authorization.
Use outputs for unlawful advertising, political deception, identity documents, biometric identification, or other high-risk deceptive uses.

8. Intellectual Property

FondPix, including the website, product design, software, workflows, templates, text, logos, brand elements, and non-user content, is owned by FondPix or its licensors. These Terms do not transfer ownership of FondPix intellectual property to you.

"FondPix" and the FondPix logo are brand identifiers. You may not use them in a way that suggests endorsement, partnership, or ownership without permission.

9. Privacy

Our handling of personal information and uploaded images is described in the Privacy Policy. By using FondPix, you acknowledge that your information will be processed as described there.

10. Service Changes and Availability

We may update, suspend, limit, replace, or discontinue parts of FondPix at any time, including models, templates, pricing, credits, output quality, storage behavior, and provider integrations. We try to keep the Service reliable, but we do not guarantee uninterrupted or error-free availability.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, FONDPIX DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY OF AI OUTPUTS.

FondPix is not responsible for decisions you make based on generated images, including wedding planning, printing, invitations, advertising, or public posting decisions.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FONDPIX WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, LOSS OF GOODWILL, OR SERVICE INTERRUPTION.

FONDPIX'S TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO FONDPIX IN THE 12 MONTHS BEFORE THE CLAIM OR (B) USD $50.

13. Indemnification

You agree to defend, indemnify, and hold harmless FondPix from claims, losses, liabilities, damages, costs, and expenses arising from your User Content, your AI outputs, your use of the Service, your violation of these Terms, or your violation of any law or third-party rights.
